THE FOREGOING LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN THEIR ENTIRETY.

The arbitration shall be conducted by a single arbitrator. The arbitrator's decision shall be final and binding on all parties and shall not be subject to appeal except on the limited grounds set forth in the Federal Arbitration Act (9 U.S.C. § 1 et seq.) ("FAA"). Judgment on the arbitration award may be entered in any court of competent jurisdiction.
The arbitration shall be conducted in English and, unless otherwise agreed by the parties, shall be conducted via written submissions, telephone, or videoconference to minimize the burden and expense on the parties.
12.3 Class Action Waiver
